Terms and Conditions of Service
These Terms and Conditions (“Terms”) govern all services provided by WIDGART (“we”, “us”, “our”) to the client (“you”, “your”), including but not limited to creative design, print production which includes all of the various disciplines of printing, logistics and project management. By engaging our services, you agree to these Terms.
1. Scope of Services
We provide creative design, print management and production services, including sourcing, kitting, logistics, and end-to-end project coordination. A detailed scope, timeline, and cost will be outlined in our proposals or quotes.
2. Quotations & Pricing
All prices quoted are in Australian Dollars (AUD) and are exclusive of GST unless otherwise stated. Quotes are valid for 30 days from the date of issue. Changes to the scope of work may result in revised pricing.
3. Approvals & Proofing
You are responsible for reviewing and approving all artwork, proofs, and production specifications. We are not liable for errors (including spelling or design issues) once your final approval is given.
4. Payment Terms
A 50% deposit may be required before commencing work, unless otherwise agreed. Final payment is COD or is due within 14 days of invoice unless stated differently on your invoice. Late payments may incur a 5% monthly fee and/or result in suspension of services.
5. Timelines & Delivery
We will make every effort to meet agreed deadlines. However, we are not liable for delays caused by third-party suppliers, courier/freight providers or events outside our control. Delivery timelines commence from the date of final artwork approval and receipt of any required Purchase Order/Deposit.
6. Intellectual Property
Copyright for original creative work remains with us until full payment is received. Upon full payment, intellectual property rights are transferred to you, unless otherwise agreed in writing.- We reserve the right to showcase completed projects in our portfolio or marketing material unless you request confidentiality.
7. Third-Party Suppliers
We may engage third-party printers, couriers, or other providers on your behalf.- While we take care to select reputable partners, we are not responsible for their errors, delays or performance.
8. Cancellations & Changes
If you cancel a project after work has commenced, you will be invoiced for work completed and any non-refundable supplier costs. Significant scope changes may require a revised quote and timeline.
9. Liability & Warranties
Our liability is limited to the value of services provided. We do not accept liability for indirect, special, or consequential damages. Any faults or errors must be reported within 7 days of receipt of goods or services.
10. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Any disputes will be handled in the courts of New South Wales.
